In a brief order today, the Second Circuit stayed the Google Books litigation while it hears Google’s appeal of class certification. This probably doesn’t say anything about whether the appeals court is sympathetic to Google’s arguments: it was decided by a single just after the author plaintiffs decided not to oppose Google’s request. My best guess is that this is related to the urgent health issue mentioned in a scheduling order last month. This development all but guarantees that the case—now about to enter its eighth year—will stretch out even longer.
